Key Points of Discussion

Informed Soldier that the chain of command is very concerned about her off-duty conduct. SPC Derrickson was ticketed on 19 May 2010 at 0145 hours for POSSESSION OF INTOXICATING BEVERAGE IN A PUBLIC PLACE BY A PERSON UNDER 21.

On 28 May 2010, she was detained and then transported to building 2025 by the Military Police after being stopped enroute to Lawton by an off-duty policeman for driving her car erratically. At that time, she was identified as having been drinking in Oklahoma City earlier that night.

A fellow Soldier has made a sworn statement that he saw SPC Derrickson with a false military ID Card bearing an incorrect birthdate. Under the direction of the Battery Commander, two Noncommissioned Officers searched your person and your room and did not find the ID card.

In addition, your performance at work since your arrival has been inconsistent and, in the opinion of your supervisor, possibly impaired at times.

These actions have caused the chain of command to question your integrity, judgment and ability to function as a Soldier in the U.S. Army.

Plan of Action

The following actions are being implemented by the chain of command: A suspension of Favorable Actions has been submitted, a Bar to Reenlistment requested against you and a Command referral into the Army Substance Abuse Program.

Informed soldier that her current off-duty conduct is causing a major problem. She understands that future instances could result in further administrative actions which include action under the UCMJ, and separation from the service under Chapter 13 or 14, AR 635-200. Soldier understands that if she is discharged for her poor duty performance, the most favorable character of discharge received may be a General discharge and that if discharged for Misconduct she may receive an Other Than Honorable Discharge. This may cause undue hardship in civilian life and may affect eligibility for Veterans Benefits, reentry into the Armed Forces and future civilian employment.
