MEMORANDUM FOR RECORD
SUBJECT: Personal Statement of SPC Gyubin Lee Regarding Article 15 Proceedings
1. I, SPC Gyubin Lee, provide this statement regarding the Article 15 proceedings imposed against me for an alleged failure to report on 18 December 2025.
2. My understanding is that the official charge on my DA Form 2627 was a single failure to report offense under Article 86, UCMJ, related to the 0630 AFT formation on 18 December 2025. The packet provided to me included that charge and limited supporting documents. I was not provided documentation for the approximately 20 prior failures to report that were later referenced during the proceedings.
3. During my first reading on or about [DATE], the Commander and First Sergeant stated words to the effect that I was "lucky" because most counseling records were no longer available and there was only one counseling in the packet. They also stated words to the effect that I knew I had many prior failures to report and that those matters should be considered in discussing the case.
4. During my second reading on or about [DATE], the Commander told me words to the effect that I would be reduced to E-3, and that although there was only one counseling in the packet, the command knew that I had more than 20 failures to report. The First Sergeant stated words to the effect that he was surprised I was only then receiving an Article 15 and that a Soldier with around 20 failures to report would normally have received several Article 15s already.
5. Based on these statements, I understood that the punishment imposed against me was influenced not only by the single charged/documented failure to report, but also by multiple prior alleged failures to report that were not included in the official packet provided to me.
6. I acknowledge that I had attendance issues in the past. However, many of the incidents referenced by the command were old, occurred approximately 1.5 to 2 years earlier, and arose during a different unit relationship. I was originally with 512th Field Hospital and attached to 519th HHD, and later became fully assigned to 519th HHD in approximately January [YEAR]. After that transition, I no longer worked under the same prior supervisory relationship.
7. My concern is not simply that old incidents were mentioned, but that those alleged incidents appeared to be used as a basis for the severity of my punishment even though the underlying documentation was missing, incomplete, or not provided to me for response. I was therefore not given a meaningful opportunity to address each of those alleged prior incidents in defense, extenuation, or mitigation.
8. Some counseling records from prior periods may no longer have existed because of unit transitions and local record handling.
9. The historical failure-to-report narrative also appears to have been influenced by a former sergeant I had worked with while I was with 512th / in a prior attached relationship, rather than by my current direct NCO at the time of the Article 15 proceedings.
10. I submitted an appeal. I understand that reduction may take effect immediately even while an appeal is pending. However, my concern remains that the punishment was based in part on undocumented and unproduced allegations outside the packet.
11. This reduction has had significant career consequences for me, including affecting my Korea PCS and related extension eligibility.
12. I provide this statement based on my best recollection and in good faith.
