SUBJECT: Receipt of Basic Housing Allowance (BAH) for SPC Thompson, Kenneth
1. I submit this memorandum on behalf of SPC Kenneth Thompson, who I represent for the purposes of assisting in the resolution of his current non-receipt of BAH issue.
2. SPC Thompson is married and has two dependents. His family (wife and child) are currently living in New York. He is assigned to duty in Grafenwoehr and is not assigned family quarters (is currently living in the barracks). Therefore, SPC Thompson should be receiving BAH for the zip code where his family resides.
3. Pursuant to the DoD Financial Management Regulation (FMR), Volume 7a, Chapter 26, a Service Member with dependents is authorized BAH at the with-dependent rate when a dependent does not accompany the Service Member to the primary duty station (PDS), preventing assignment of family quarters. This situation does not prevent the Service Member from receiving BAH or OHA for a dependent.
