MEMORANDUM For Letter of Review, on behalf of myself, SPC Rodriguez, Isaih M.
SUBJECT: Request for Leave Approval & Extension of Orders IAW AR 600-8-10 & AR 635-40
1. Purpose: This memorandum respectfully requests approval to utilize my accrued leave days and extend my current medical retirement orders with a revised No Later Than Date (NLTD) to 30 August or 30 September 2025.
2. Background: I am currently pending involuntary medical retirement, with orders indicating an NLTD of 30 July 2025 and an original date of 17 August 2025. Despite consistent efforts over the past six+ months, including outreach to patient advocacy, Chain of Command (CoC) requests, sick hall coordination, and frequent walk-in checks at clinics, I have been unable to accelerate the necessary specialty appointments. These appointments are required to diagnose and address a potentially serious condition that began with an incident of anaphylactic shock at (NTC) in June 2024. I have actively pursued care with the Mendoza Clinic, Allergy, Pulmonology, and Dermatology departments and am now pending Neurology and ENT referrals, along with follow-up diagnostics.
3. Justification and Reference to Regulation:
a. I currently have 60 days of accrued leave and seek to utilize this time, IAW AR 600-8-10, Ch. 2- 2a, which emphasizes that Soldiers should be encouraged to use leave to the maximum extent to support their health, morale, and efficiency.
b. Additionally, AR 600-8-10, Ch. 4-9, supports the use of accrued leave in conjunction with retirement (transition/terminal leave). Given that I am currently under medical retirement proceedings per AR 635-40, extending my orders will allow me to complete pending diagnostic and treatment requirements.
c. AR 600-8-10 also supports granting leave when there is evidence of deteriorating health (para 2-2e(5)). The very basis for my medical separation is my Atopic Dermatitis; however, after the anaphylactic shock episode, there is a necessity to locate the basis of my illness before relocation.
d. According to AR 635-40, para 1-1c, prompt disability processing must be balanced with protection of the Soldier's rights. Extending my orders would not only be consistent with that policy but would ensure a thorough medical evaluation is completed before final separation.
4. Request: I respectfully request approval for the following:
o Authorization to utilize my accrued 60 days of leave in place.
o Extension of my current orders with a revised NLTD to either 30 August or 30 September 2025, to allow sufficient time for pending and referred medical evaluations and treatments.
5. Conclusion: Granting this request will allow continuity of care and completion of medical evaluations that are essential to my long-term health. It aligns with Army policies and maintains the integrity of the Disability Evaluation System (DES) process as outlined in AR 635-40. I appreciate your time and consideration in this matter and remain committed to upholding the Army's standards and values through the completion of my service.
