MEMORANDUM FOR RECORD
SUBJECT: Inappropriate Conduct Incident During FARP Operations - CPT Rivera
Purpose: The purpose of this memorandum is to document an incident that occurred between 25 - 29 May 2025 during operations conducted at Collazo Airfield in Salinas, Puerto Rico, in support of the setup and execution of the Forward Arming and Refueling Point (FARP).
Summary of Events:
a. On 25 May 2025 at approximately 0813 hours, we began unloading the LMTV at Collazo Airfield. A team of Soldiers was assigned to assist SGT Ortiz with unloading the POL equipment from the LMTV. Meanwhile, SPC Cans and I located the fuel farm using the HEMTT. We then proceeded to the FARP to position the HEMTT and begin setup operations with our assigned crew.
b. Once the HEMTT was positioned, I instructed SPC Cans to assist me in retrieving water from Building 800 using the small vehicle provided to us, in order to ensure hydration for all personnel. We then resumed FARP setup operations and completed them successfully.
c. After completing these tasks, CPT Rivera instructed me to give work assignments to SPC Cans, claiming that she "was not doing anything" and making inappropriate comments about her appearance, such as "she's pretty with her pretty hair" and that she just sits around doing nothing. As the NCOIC, I informed CPT Rivera that at no time had SPC Cans avoided her duties and that she had been working alongside the rest of the team.
d. CPT Rivera continued making similar remarks over the following days -26, 27, 28, and 29 May, insisting that I relocate SPC Cans and assign her duties under the sun, using a tone and demeanor that were unprofessional.
e. On Thursday, 29 May, at around 0800 hours, while I was performing my daily duties on the HEMTT at Collazo Airfield, SGT Ortiz informed me that CPT Rivera was looking for a way to change the plan in order to go get fuel. I responded that, as the NCOIC, I had already planned that logistical action for the following day, and that CPT Rivera could not alter pre-established plans without potentially compromising the mission.
f. At approximately 0930 hours, CPT Rivera arrived on site. I explained to her that the fuel logistics had already been planned and should not be changed. At 0950 hours, SFC Romen arrived at the site. CPT Rivera spoke with him and shortly afterward asked me to show SFC Romen the FARP setup and explain the work being done.
g. At 1003 hours, CPT Rivera began telling SFC Romen that I was not performing my duties as NCOIC and NCO, and that I was not keeping my Soldiers engaged. He specifically pointed out SPC Cans and continued to undermine my position as NCOIC and team leader of the FARP operation and POL section. Additionally, CPT Rivera continued making negative remarks about me personally, claiming that I was excluding people from the mission and making female Soldiers from the Reserve feel uncomfortable. These statements are completely false, as these Soldiers provided excellent support and worked extremely hard to ensure mission success.
Action Taken: Due to the false and unprofessional comments made by CPT Rivera, which affected the integrity of the mission and the morale of the team, I felt compelled to report the incident to my chain of command for appropriate action to be taken.
Conclusion: The statements made by CPT Rivera do not reflect the teamwork and professionalism displayed by the personnel under my leadership. As NCOIC, I have maintained the highest standards of professionalism and mission execution, ensuring success throughout the FARP operation.
