Failure to Comply with Restrictions

This counseling is documenting misconduct, specifically:

Failure to obey a lawful order.
Failure to maintain accountability.
Failure to notify leadership before leaving the hotel.
Operating a vehicle despite a command-directed restriction.
Failure to Comply with Driving Restrictions and Failure to Inform Leadership of Movement.


You were given a lawful order and informed that you were not authorized to operate a motor vehicle by yourself due to established safety concerns and command-directed restrictions. Despite understanding this directive, you knowingly disregarded the order and operated a vehicle alone.

Additionally, while staying at the hotel, you failed to inform your chain of command or leadership that you intended to leave the hotel to conduct personal errands. At no point did you notify your leadership of your departure, destination, expected return time, or transportation plans. This lack of communication prevented leadership from maintaining accountability and ensuring compliance with the restrictions placed upon you.

Your actions demonstrate a failure to obey a lawful order, poor judgment, and a disregard for established accountability procedures. By operating a vehicle in violation of a direct order and failing to notify leadership of your whereabouts, you placed yourself, other Soldiers, and members of the public at unnecessary risk. Your actions also created unnecessary concern regarding your safety and welfare and undermined the trust and confidence leadership places in your ability to follow instructions.

As a Soldier, you are expected to comply with all lawful orders and maintain communication with your chain of command, particularly when restrictions and accountability measures are in place. Failure to obey orders and maintain accountability may result in administrative or disciplinary action under the Uniform Code of Military Justice (UCMJ), including action under Article 92, Failure to Obey an Order or Regulation.


Plan of Action:

You will immediately cease operating a vehicle by yourself until authorized by the chain of command.

You will inform your first-line leader or designated representative prior to departing the hotel or place of lodging for any reason.

You will maintain communication with leadership and provide your destination, means of transportation, and estimated return time when departing for personal errands.

You will comply with all current restrictions and accountability requirements.

Any future violations may result in additional counseling and disciplinary action.


Leader Responsibilities:

Ensure the Soldier understands the driving restrictions and accountability requirements and monitor compliance with all directives.
